Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Digital Straightjacket software, website, and related services (collectively, the "Service") provided by Digital Straightjacket. By creating an account, joining our waitlist, or using the Service, you agree to these Terms.

1. The Service

Digital Straightjacket is an independent risk-management tool that lets traders define and enforce self-imposed trading constraints at the device level. The Service does not place trades on your behalf, hold funds, or connect to your broker as an authorized agent.

2. Eligibility & Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information you provide and for safeguarding your account credentials and any actions taken under your account.

3. Subscriptions & Billing

Paid plans are billed in advance on a recurring basis (monthly or annually) until cancelled. Fees are non-refundable except where required by law. We may change pricing with reasonable notice; continued use after a price change constitutes acceptance.

4. Acceptable Use

You agree not to reverse engineer, tamper with, disable, or attempt to circumvent the Service's enforcement mechanisms, resell or redistribute the Service without authorization, or use it for any unlawful purpose.

5. Independent Service Disclaimer (No Affiliation)

Digital Straightjacket is an independent, third-party software provider developed specifically for professional risk governance. We are not an agent, partner, employee, or representative of Tradovate or any other brokerage, platform, or financial institution. Any connection to or compatibility with third-party trading platforms is provided for technical convenience only. Digital Straightjacket has no control over, and assumes no responsibility for, the policies, services, or performance of any third-party brokerage platform.

6. Risk Governance & Financial Disclaimer

Digital Straightjacket is a software-based tool for risk governance and is intended for use by experienced traders. Use of this software does not constitute financial, investment, or trading advice. Trading in financial markets involves a substantial risk of loss and is not suitable for everyone. Users are solely responsible for all trading decisions, the configuration of their own risk parameters, and the financial consequences of their trading activity. Digital Straightjacket does not provide signals or trade recommendations, and we do not warrant that our software will prevent all financial losses. Past performance is not indicative of future results.

7. Intellectual Property

The Service, including all software, content, and trademarks, is owned by us or our licensors and is protected by applicable intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

8. Limitation of Liability

To the maximum extent permitted by law, the Service is provided "as is" without warranties of any kind, and we will not be liable for any indirect, incidental, or consequential damages, or for any trading losses, arising from your use of or inability to use the Service. We are not liable for any losses resulting from technical failures, API latency, internet connectivity issues, or delays in the execution of risk-governance commands by third-party platforms.

9. Termination

We may suspend or terminate your access if you breach these Terms. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or by email, and continued use after changes take effect constitutes acceptance.
